Under the Asylum Act, serious harm includes the imposition or execution of the death penalty. In this regard, it should be noted that the Directive explicitly refers to “death penalty or execution”, which indicates that the concept covers not only the imposition of capital punishment within criminal proceedings but also the risk of extrajudicial execution. |
