As of 31 December 2025, there is no border procedure in Slovakia. The new IPA envisages the introduction of a new border procedure in Articles 9 – 10 of the Act. Based on the new legislation that comes into force on 12 June 2026, if the BBFP PFP determines that an application for international protection is to be examined in the border asylum procedure, it shall issue a decision restricting the freedom of movement of the applicant for international protection. Such a decision may be challenged before the administrative courts by way of an administrative appeal; however, the submission of such an action does not have automatic suspensive effect.
During the border asylum procedure, applicants will be accommodated in a specialised border asylum facility where they will be required to reside. The conditions for leaving the facility will be laid down in the internal rules of the facility. Where an applicant is required to appear before a public authority or a court, they must notify the facility at least two days in advance.
