Country Report: Safe third country

The safe third country concept is not included in Italian law. However, in the first months of 2026, in at least on case, the Territorial Commission of Trieste denied international protection considering that the man could return to a third safe country. The Territorial Commission rejected the asylum application considering that the man, Palestinian, could come back to Morocco where his family was living. The man appealed the decision and the appeal is pending.
